1. Changes to These Terms

We are constantly trying to improve our Services, so these Terms may need to change along with our Services. We reserve the right to change the Terms at any time, but if we do, we will place a notice on our website, send you an email, and/or notify you by some other means.

If you don't agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

2. Privacy

Freedom Age takes the privacy of its users very seriously. For our current Privacy Policy, please visit our Privacy Policy page.

3. Children's Privacy

We do not knowingly collect or solicit personally identifiable information from children under 18 years of age, as you must be 18 years or older to sign up for an account. If you are under 18 years of age, please do not attempt to register for or otherwise use the Services or send us any personal information. If we learn we have collected personal information from a child under 18 years of age, we will delete that information as quickly as possible. If you believe that a child under 18 may have provided us personal information, please contact us at support@myfreedomage.com.

4. Financial Data and the Gramm-Leach-Bliley Act

Freedom Age is committed to protecting your privacy and safeguarding the nonpublic personal information ("NPI") that you provide via the Services. Pursuant to the Gramm-Leach-Bliley Act ("GLBA"), we follow strict guidelines to ensure the confidentiality, integrity, and security of your personal financial information.

By using Freedom Age's Services, you acknowledge and agree that Freedom Age collects, processes, and uses your personal financial data as outlined in our Privacy Policy. Freedom Age may share certain NPI with Service Providers as required to offer the Services in accordance with our Privacy Policy. However, Freedom Age will not disclose your personal, financial NPI to non-affiliated third parties without your explicit consent, except as permitted by law.

If you choose to terminate your relationship with Freedom Age, we will continue to safeguard your NPI according to our privacy obligations under GLBA.

5. Account Basics

You may be required to sign up for an account and provide us with certain information, such as your contact information. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not transfer your account to anyone else without our prior written permission.

You may access the Services using your account credentials from other services (each, a "Third Party Account"), such as those offered by Google. By using the Services through a Third Party Account, you permit us to access certain information from such account for use by the Services.

You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Services and have gotten your parent or guardian to agree to these Terms on your behalf).

You will only use the Services for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you.

You will not share your account credentials with anyone, and you must protect the security of your account and any access tools or credentials. You're responsible for any activity associated with your account.

6. Linking Financial Accounts

Freedom Age allows you to link your financial accounts through a third-party financial data aggregation service. By linking your accounts, you:

• Authorize Freedom Age and our third-party provider to access your financial account information, including account balances, holdings, and transaction history.
• Understand that Freedom Age does not receive or store your bank login credentials. Your credentials are securely managed by our third-party financial data aggregation provider.
• Acknowledge that the accuracy and availability of your financial data depends on the third-party provider and your financial institutions.
• May revoke access to your linked accounts at any time through your account settings or by contacting us.

Freedom Age uses your linked financial data solely to provide you with personalized financial planning insights, including calculating your Freedom Age and analyzing your financial position.

7. Restrictions on Use

You represent, warrant, and agree that you will not use or interact with the Services in a manner that:

• Infringes or violates the intellectual property rights or any other rights of anyone else (including Freedom Age).
• Violates any law or regulation, including any applicable export control laws or privacy laws.
• Is dangerous, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
• Jeopardizes the security of your account or anyone else's.
• Attempts to obtain the password, account, or other security information from any other user.
• Violates the security of any computer network, or cracks any passwords or security encryption codes.
• Runs any automated processes, "crawlers," "scrapers," or "spiders" on any page, data, or portion of the Services.
• Copies or stores any significant portion of the Content.
• Decompiles, reverse engineers, or otherwise attempts to obtain the source code of the Services.

A violation of any of the foregoing is grounds for termination of your right to use or access the Services.

8. Intellectual Property

The materials displayed or available on or through the Services, including text, graphics, data, articles, photos, images, illustrations, and AI-generated content (all of the foregoing, the "Content") are protected by copyright and/or other intellectual property laws. You promise to abide by all intellectual property notices and restrictions contained in any Content you access through the Services.

Subject to these Terms, we grant each user of the Services a worldwide, non-exclusive, non-sublicensable, and non-transferable license to use Content solely for purposes of using the Services. You understand that Freedom Age owns the Services.

9. Not Financial Advice

You agree that you are responsible for your own financial decisions, that Freedom Age is only one of many tools you may use as part of a comprehensive financial planning process, and that you should not and will not rely on Freedom Age as the primary basis of your financial decisions.

Nothing provided through the Services should be construed as tax advice, a solicitation or offer, or a recommendation to buy or sell any security. All financial calculations, projections, and insights are based on mathematical models and assumptions that may not reflect your actual future financial outcomes.

Before making significant financial decisions, you should consult with a qualified financial advisor, tax professional, or legal advisor regarding your specific situation.

By using the Services, you understand and acknowledge that:

• Any results or projections, including your "Freedom Age," are estimates based on the information you provide and mathematical models, and cannot be guaranteed.
• All financial decisions you make are subject to various market, currency, economic, political, business, and other risks, and you may lose money.
• Past performance and historical data do not guarantee future results.

10. AI-Powered Services and Limitations

Freedom Age uses artificial intelligence to provide personalized financial planning insights. You understand and acknowledge the limitations of AI, including:

• AI technology may occasionally generate incorrect, incomplete, misleading, irrelevant, or nonsensical information.
• You need to review and verify the accuracy of AI-generated information before relying on it.
• You should not rely solely on AI-generated information for financial decisions.
• All financial figures presented through the AI assistant are derived from validated mathematical models and your provided inputs, not independently generated by the AI.

Freedom Age is not liable for any decisions you make based on data or information displayed or provided through the Services, including AI-generated content.

11. Third-Party Services

In certain instances, we integrate with third-party service providers to offer you additional functionality as part of the Services, including financial data aggregation, authentication, and AI processing. If you use these third-party services as part of your use of our Services, you agree to abide by the terms and conditions of such third-party providers.

Freedom Age has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of any third-party service. We encourage you to read the terms and conditions and privacy policy of each third-party service that you utilize through our Services.

Freedom Age cannot always foresee or anticipate technical or other difficulties which may result in failure to obtain data or loss of data, personalization settings, or other interruptions to our Services. Freedom Age cannot assume responsibility for the timeliness, accuracy, deletion, non-delivery, or failure to store any user data, communications, or personalization settings.

12. Changes to the Services

We're always trying to improve our Services, so they may change over time. We may suspend or discontinue any part of the Services, or we may introduce new features or impose limits on certain features or restrict access to parts or all of the Services. We'll try to give you notice when we make a material change that would adversely affect you, but this isn't always practical.

13. Fees

The Services are currently free, but we reserve the right to charge for certain or all Services in the future. We will notify you before any Services you are then using begin carrying a fee, and if you wish to continue using such Services, you must pay all applicable fees.

14. Termination

You're free to stop using the Services at any time by contacting us at support@myfreedomage.com. Please refer to our Privacy Policy to understand how we treat your information after you have stopped using our Services.

Freedom Age is also free to terminate or suspend access to your use of the Services or your account for any reason in our discretion, including your breach of these Terms.

Account termination may result in destruction of any Content associated with your account. Provisions that, by their nature, should survive termination of these Terms shall survive termination, including any obligation you have to indemnify us, any limitations on our liability, any terms regarding ownership or intellectual property rights, and terms regarding disputes between us.

You agree to indemnify and hold Freedom Age harmless from and against any and all claims, liabilities, damages (actual and consequential), losses, and expenses (including attorneys' fees) arising from or in any way related to any claims relating to (a) your use of the Services (including any actions taken by a third party using your account), and (b) your violation of these Terms.

18. Arbitration Agreement

Please read the following arbitration agreement carefully because it requires you to arbitrate certain disputes and claims with Freedom Age and limits the manner in which you can seek relief from Freedom Age.

Arbitration Rules

The parties shall use their best efforts to settle any dispute, claim, question, or disagreement arising out of or relating to the subject matter of these Terms directly through good-faith negotiations, which shall be a precondition to either party initiating arbitration. If such negotiations do not resolve the dispute, it shall be finally settled by binding arbitration in San Francisco County, California, in accordance with the JAMS Streamlined Arbitration Rules and Procedures then in effect, by one commercial arbitrator with substantial experience in resolving commercial contract disputes.

Costs of Arbitration

Freedom Age will pay all arbitration fees for claims less than seventy-five thousand ($75,000) dollars. Freedom Age will not seek its attorneys' fees and costs in arbitration unless the arbitrator determines that your claim is frivolous.

Small Claims Court

Either you or Freedom Age may assert claims, if they qualify, in small claims court in San Francisco County, California, or any United States county where you live or work.

Opt-out

You have the right to opt out of the provisions of this arbitration agreement by sending written notice of your decision to opt out to support@myfreedomage.com, postmarked within thirty (30) days of first accepting these Terms. You must include (i) your name and residence address, (ii) the email address associated with your account, and (iii) a clear statement that you want to opt out of these Terms' arbitration agreement.

19. Choice of Law

These Terms are governed by and will be construed under the Federal Arbitration Act, applicable federal law, and the laws of the State of California, without regard to the conflicts of laws provisions thereof.

20. Miscellaneous

The failure of either you or us to exercise, in any way, any right herein shall not be deemed a waiver of any further rights hereunder. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

You and Freedom Age agree that these Terms are the complete and exclusive statement of the mutual understanding between you and Freedom Age, and that these Terms supersede and cancel all previous written and oral agreements, communications, and other understandings relating to the subject matter of these Terms.

You hereby acknowledge and agree that you are not an employee, agent, partner, or joint venture of Freedom Age, and you do not have any authority of any kind to bind Freedom Age in any respect whatsoever.
